Tritan BP LTD Terms & Conditions

Effective Date: 6 September 2026

Please read these Terms carefully before placing an order. These Terms apply to purchases made from Tritan BP LTD through our website, by telephone, by email, or through an authorised quotation or invoice. Nothing in these Terms affects any legal rights that cannot lawfully be excluded or limited.

These Terms and Conditions apply to all orders placed with Tritan BP LTD (“Tritan BP”, “we”, “us”, or “our”). By placing an order, you confirm that you have read and accepted these Terms.

A “Consumer” is an individual purchasing mainly for personal use. A “Business Customer” is a person or organisation purchasing wholly or mainly for business, trade, craft, or professional purposes. Certain legal protections described below apply only to Consumers.

2. Orders and Contract Formation

  • Submitting an order is an offer to purchase the products shown in the order.
  • A contract is formed only when we send an order confirmation or otherwise confirm in writing that we have accepted the order.
  • An automated acknowledgement that we have received an order does not necessarily mean that the order has been accepted.
  • We may refuse or cancel an order before acceptance, including where a product is unavailable, a price or description is materially incorrect, payment is not authorised, fraud is suspected, or delivery cannot reasonably be completed.
  • If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled items.
  • You are responsible for checking that all measurements, quantities, colours, delivery details, and product selections are correct before submitting the order.

3. Prices, VAT and Payment

  • Prices offered to Consumers include VAT where applicable unless clearly stated otherwise.
  • Prices quoted exclusively to Business Customers may be shown excluding VAT where this is clearly stated.
  • Delivery to any UK address is free of charge. Any other unavoidable charges will be shown or communicated before an order is finalised.
  • Orders must be paid in full at the time of purchase unless written credit or deposit terms have been agreed.
  • We may correct an obvious pricing error before dispatch. If the corrected price is higher, we will contact you and give you the option to proceed at the corrected price or cancel for a refund.
  • Title to the goods remains with Tritan BP LTD until payment has been received in full, without affecting the point at which risk passes under Section 7.

4. Product Descriptions, Samples and Natural Variation

  • We take reasonable care to ensure that product descriptions, dimensions, specifications, coverage information, prices, and availability are accurate. Minor errors or omissions may occasionally occur and may be corrected without notice.
  • Images are intended to provide a reasonable representation of the product but are not a guarantee of exact colour, texture, depth, scale, sheen, joint pattern, or finished appearance.
  • Appearance may vary because of lighting, photography, screen settings, manufacturing tolerances, hand-finishing, production batches, installation methods, surrounding materials, and natural weathering.
  • Samples are representative only. A sample may not display every colour, texture, or feature present across a full-size product or a later production batch.
  • We strongly recommend ordering and approving a sample before placing a larger order, particularly where colour matching is important.
  • Coverage calculations and quantity recommendations are estimates based on information supplied by the customer. Allowances may be required for cuts, corners, waste, pattern matching, damage, future repairs, and installer technique.

5. AI-Assisted and Illustrative Content

  • We may use artificial intelligence, automated tools, digital editing, computer-generated imagery, or similar technology to assist in creating or improving product descriptions, articles, videos, images, room scenes, exterior scenes, design concepts, renderings, advertisements, and other marketing or informational content.
  • AI-assisted, digitally altered, computer-generated, or conceptual content is provided for inspiration and general illustration only. It may depict a product in a setting, size, arrangement, colour, lighting condition, or installation that differs from the product supplied.
  • Such content must not be relied upon as an exact technical drawing, installation instruction, colour match, structural design, professional specification, or guarantee of the finished result.
  • Where there is any inconsistency, the applicable written quotation, order confirmation, current product specification, technical data sheet, installation instructions, and written warranty terms will take precedence over illustrative or marketing content.
  • We review content before publication where reasonably practicable, but AI-assisted or automated content may occasionally contain inaccuracies. Please contact us before purchase where a particular specification or representation is important to your decision.
  • Where AI tools are used to process personal information, that processing will be addressed in our Privacy Policy. We do not use AI-generated marketing content to remove or restrict rights provided by law.

6. Product Suitability, Installation and Use

  • You are responsible for confirming that a product is suitable for the intended location, substrate, exposure, building type, fire-performance requirement, and applicable project requirements before purchase and installation.
  • Products must be stored, handled, cut, prepared, installed, sealed, coated, maintained, and used in accordance with our current written instructions and any applicable laws, building regulations, codes, and manufacturer instructions for related materials.
  • Installation advice, quantity estimates, sketches, renderings, or technical support provided by us are general guidance based on the information made available to us. They do not replace the judgement of a competent installer, architect, engineer, building-control professional, or other qualified adviser where one is required.
  • Unless we have expressly agreed in writing to provide installation services, the installer is independent of Tritan BP LTD and we are not responsible for the installer's workmanship.
  • Outdoor products may gradually change or fade through exposure to sunlight, ultraviolet radiation, moisture, pollution, temperature changes, weather, and cleaning products. Normal weathering is not necessarily a defect.
  • Do not begin installation if products appear damaged, incorrect, materially inconsistent with the approved sample, or otherwise unsuitable. Contact us before cutting, coating, modifying, or installing them.

7. Delivery, Access and Risk

  • Delivery dates and time windows are estimates unless we expressly agree a guaranteed date in writing.
  • For Consumer orders, we will deliver within the agreed period or, where no period is agreed, within the period required by applicable law.
  • Unless otherwise agreed, palletised or freight deliveries are kerbside only. You must ensure safe and reasonable access for the delivery vehicle and arrange suitable people or equipment to move goods from the kerbside delivery point.
  • Additional charges caused by incorrect delivery information, failed access, refused delivery without lawful justification, redelivery, specialist vehicles, storage, or waiting time may be charged where legally permitted and reasonably incurred.
  • For Consumers, risk passes when the goods come into the physical possession of you or a person identified by you to receive them, except where you independently appoint a carrier not offered by us.
  • For Business Customers, risk passes on delivery at the agreed delivery point unless otherwise agreed in writing.
  • Ownership does not pass until we have received payment in full.

8. Inspection, Transit Damage and Incorrect Deliveries

  • Please inspect packaging and goods as soon as reasonably possible after delivery.
  • Where visible transit damage is present, please note it on the delivery record where possible and send photographs of the packaging, pallet, labels, and affected goods promptly.
  • Please report visible damage, shortages, or incorrect items within 48 hours of delivery where reasonably possible, and concealed damage within 48 hours of discovery. Prompt notice helps us investigate with the carrier.
  • These requested reporting periods do not remove or reduce a Consumer's statutory rights where it would be unlawful to do so.
  • Keep all packaging and damaged products until we confirm whether they are required for inspection, collection, or a carrier claim.
  • Do not install a product known to be damaged or incorrect. Installing an item after discovering an obvious issue may affect the remedies reasonably available for avoidable installation or removal costs, but it does not remove rights that cannot lawfully be excluded.

9. Consumer Right to Cancel Distance Orders

This Section applies to Consumers who purchase online, by telephone, or by email. It does not apply to Business Customers.

  • You normally have the right to cancel an eligible distance order within 14 days after the day you, or a person nominated by you, receives the goods.
  • For an order delivered in separate instalments, the cancellation period normally runs from the day after the final item or instalment is received.
  • To cancel, you must make a clear statement of your decision before the cancellation period expires. You may email support@tritanbp.co.uk or write to the address in Section 19. You do not have to use a particular form.
  • After notifying us of cancellation, you must return the goods without undue delay and normally no later than 14 days after notifying us.
  • You are responsible for the direct cost of returning cancelled goods unless we agreed to pay that cost, the goods are faulty or incorrect, or applicable law requires otherwise. Large, palletised, or freight items can be expensive to return.
  • Where goods cannot normally be returned by post, please contact us for available return or collection options. Any collection charge payable by you will reflect the direct and reasonable cost of collection and will be communicated before collection is arranged.
  • We may withhold reimbursement until we receive the goods back or you provide evidence that they have been returned, whichever occurs first.
  • We will refund eligible payments, including the least expensive standard outbound delivery option offered by us, using the original payment method unless otherwise agreed.
  • We may reduce the refund to reflect any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
  • No restocking fee applies to a valid statutory cancellation made within the legal cancellation period.

10. Exceptions to the Consumer Cancellation Right

The statutory cancellation right may not apply to:

  • goods made to the customer's specifications or clearly personalised;
  • custom colours, custom finishes, custom-fabricated products, cut-to-size products, made-to-order beams, mantels, or other products produced or modified specifically for the customer;
  • sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed, where applicable;
  • goods that become inseparably mixed with other items after delivery; or
  • any other category excluded by applicable law.

An item is not automatically excluded merely because it was not held in stock. We will identify genuinely custom or non-cancellable products before the order is finalised wherever reasonably practicable.

11. Our 30-Day Returns Promise

  • We accept standard, non-custom products returned within 30 days of delivery, for any reason.
  • This promise is offered in addition to a Consumer's statutory rights. It does not restrict rights relating to faulty, damaged, misdescribed, or incorrect goods, and it does not replace the statutory cancellation right described in Section 9.
  • Products must be unopened, in their original packaging, and in resaleable condition.
  • No return authorisation number is required. Email support@tritanbp.co.uk with your order number and we will send you the return address within one working day.
  • No restocking fee applies. You receive the full price of the goods back.
  • Return transport is the customer's responsibility, cost and risk unless the goods are faulty, damaged or incorrect, or unless we agree otherwise. We recommend a tracked and insured service.
  • Custom, personalised, made-to-order, cut, installed, used, or modified products are not eligible under this promise unless we agree otherwise in writing. Where these are also excluded from the statutory cancellation right, Section 10 applies.
  • Refunds are issued to the original payment method within 5 working days of us receiving and checking the returned goods.

12. Faulty, Misdescribed or Incorrect Goods

  • We are responsible for supplying goods that conform to the contract and meet the standards required by applicable law.
  • If you believe goods are faulty, misdescribed, or incorrect, contact us promptly with the order number, a description of the issue, and reasonable supporting photographs or video where available.
  • We may ask for the goods to be inspected or returned before confirming the appropriate remedy.
  • Consumer remedies may include the short-term right to reject, repair, replacement, price reduction, or final right to reject, depending on the circumstances and applicable law.
  • Where goods are confirmed to be faulty, misdescribed, or incorrect, we will bear reasonable return or collection costs where required by law.
  • Nothing in these Terms limits a Consumer's statutory rights under the Consumer Rights Act 2015 or other applicable consumer law.

13. Order Changes and Cancellations Before Dispatch

  • Contact us as soon as possible if you wish to change or cancel an order.
  • Standard stocked orders may generally be cancelled before dispatch, subject to any rights provided by law.
  • Custom, personalised, cut-to-size, fabricated, or made-to-order products cannot normally be changed or cancelled after production or procurement has begun, except where the law provides otherwise or we agree in writing.
  • Approved changes may affect price, availability, and delivery estimates.

14. Warranties

  • Any written manufacturer or Tritan BP limited warranty supplied with a product is subject to its own terms, exclusions, claim process, and duration.
  • A commercial warranty is additional to, and does not replace or reduce, a Consumer's statutory rights.
  • Unless expressly covered by a written warranty, warranty coverage does not extend to improper storage, incorrect installation, unsuitable substrates, structural movement, impact, misuse, neglect, unauthorised modification, use contrary to instructions, normal wear, expected weathering, or ordinary colour change from environmental exposure.

15. Email, SMS and Marketing Communications

  • We may send service communications necessary to manage enquiries, quotations, orders, deliveries, returns, warranties, accounts, and customer support.
  • We will send electronic marketing to individuals only where we have a lawful basis to do so, such as valid consent or where the applicable existing-customer rules permit it.
  • Submitting contact details for an enquiry or purchase does not by itself require you to agree to unrelated marketing.
  • Where you opt in, marketing may include project ideas, product information, sample follow-ups, cart reminders, surveys, and promotional offers.
  • You may unsubscribe from marketing emails using the unsubscribe link or by contacting us. You may opt out of marketing SMS messages by replying STOP where that function is available.
  • Opting out of marketing will not prevent essential service or transactional communications.
  • Our collection and use of personal information is described in our Privacy Policy.

16. Intellectual Property and Website Use

  • Unless otherwise stated, the website and its text, product names, graphics, photographs, videos, renderings, layouts, downloads, and other content are owned by or licensed to Tritan BP LTD and are protected by applicable intellectual-property laws.
  • You may view, print, or save reasonable portions for personal evaluation of our products.
  • You may not copy, scrape, republish, modify, sell, license, distribute, remove watermarks from, or commercially exploit our content without prior written permission, except where permitted by law.
  • You must not use the website in a way that damages, disrupts, compromises, or unlawfully accesses the website, its systems, or another person's information.

17. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or breach of rights that cannot lawfully be excluded.

Consumers

  • If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill.
  • We are not responsible for loss or damage that was not foreseeable, for losses caused by incorrect information supplied by you, or for avoidable loss resulting from installation or continued use after an obvious issue should reasonably have been reported.
  • We supply products to Consumers for domestic and private use. We are not responsible to a Consumer for business losses arising from use primarily for business purposes.

Business Customers

  • To the fullest extent permitted by law, we are not liable for loss of profit, revenue, business, contracts, anticipated savings, goodwill, reputation, production, or any indirect or consequential loss.
  • Subject to liabilities that cannot lawfully be limited, our total aggregate liability arising from an order will not exceed the price paid or payable for the products giving rise to the claim.
  • Any implied terms are excluded to the fullest extent permitted in a business-to-business contract.

18. General Terms

  • If any provision is found unlawful or unenforceable, the remaining provisions will continue in effect.
  • A delay in enforcing a right does not waive that right.
  • No person other than you and Tritan BP LTD has a right to enforce these Terms, except where the law expressly provides otherwise.
  • We may update these Terms from time to time. The version in force when your order is accepted will normally govern that order unless a change is required by law or agreed with you.
  • Headings are included for convenience and do not affect interpretation.

19. Governing Law and Disputes

  • These Terms and any dispute or claim arising from them are governed by the laws of England and Wales.
  • If you are a Consumer living elsewhere in the United Kingdom, you may also benefit from mandatory protections of the law applicable where you live and may have the right to bring proceedings in your local courts.
  • If you are a Business Customer, the courts of England and Wales will have exclusive jurisdiction unless we agree otherwise in writing.
  • Please contact us first so that we have an opportunity to resolve any complaint promptly and fairly.
